This is a great explainer on how the US President gets to set tariffs. The power to levy tariffs is granted by the Constitution to CONGRESS, but through various laws (and some judicial review), the power of tariff-setting has largely been delegated to the Executive.
But Trump has abused those laws. There is no emergency. There is no danger to national security. There is no industry facing imminent threat. And in most cases, there is no unfair tariff to retaliate against. The way Trump acted is far outside the authority given by those laws.
Congress delegated their power to the Executive, therefore they can un-delegate it. It’s entirely within Congress’s power to rebuke Trump’s abuse and rescind his tariffs.
