"Mahmoud Khalil, the green card holding legal permanent resident arrested by ICE on Saturday, and a group of other students are suing Columbia University, the university’s trustees, and a number of other officials, according to newly filed court records.
The move is the latest episode in one of the most high profile immigration cases in the country, which could set a precedent for under what grounds the U.S. can deport legal residents who have not been charged with a crime. Authorities have previously said that Khalil was arrested because he “led activities aligned to Hamas,” without providing evidence for how Khalil was aligned with the terrorist organization, and he has not been charged with a crime.
Specifically, the group is suing to stop Columbia University and Barnard College from producing “all student or student-worker disciplinary records” to the U.S. House of Representatives Committee on Education and the Workforce."

"The demonstrators from Jewish Voice for Peace wore red shirts reading 'Jews say stop arming Israel' and held up banners as they chanted 'Bring Mahmoud home now!' on the lower level of the Fifth Avenue building's public atrium.
"After warning the protesters to leave, police said they arrested 98 people who stayed on various charges, including trespassing, obstruction and resisting arrest.
"Khalil, a 30-year-old permanent U.S. resident who is married to an American citizen and who hasn't been charged with breaking any laws, was arrested outside his New York City apartment Saturday and faces deportation. He's being held at an immigration detention center in Louisiana."

"Khalil’s attorneys plan to contest his detention on free speech grounds under the First Amendment and by challenging the government’s use of the '#ForeigPolicy' provision. By evoking the 'foreign policy' provision, the Trump administration is making a clear statement not just about its foreign policy goals but also free speech, Azmy said.
"'The United States government thinks Mahmoud’s speech in favor of Palestinian human rights and to end the genocide is not only contrary to U.S. foreign policy, which is something in itself, but that that dissent provides grounds for arrest, detention, and deportation,' Azmy said. 'It’s an astonishing claim.'
"Central to their challenge in court will likely be another provision within the Immigration and Nationality Act that exempts #noncitizens facing deportation under the government’s “foreign policy” provision. The exception, known as Section 212(a)(3)(C)(iii), says that an individual cannot be deported under the 'foreign policy' provision cited by the government if their 'past, current, or expected beliefs, statements, or associations, if such beliefs, statements, or associations would be lawful within the United States.'
"In other words, since Khalil’s past activities were protected free speech under the First Amendment, he should not be deported under the 'foreign policy' provision cited by the government, Azmy said. The Department of Homeland Security has said it arrested Khalil, a lead negotiator for #Palestine solidarity protesters at Columbia, for having 'led activities aligned to Hamas.' But even if such alignments exist, advocacy is protected activity in the U.S., Khalil’s attorneys maintain.
"'If there is constitutionally protected speech,' Azmy said. 'It doesn’t matter if it goes adverse to the foreign policy interests of the United States — it’s still protected. The government doesn’t get to decide what you can talk about and what you cannot talk about based on whether or not it helps the U.S.'"

"I’m incredibly freaked out about the regime grabbing people from their homes who are legally in the United States, with permanent status — not just visas permitting them to work or study here but green cards — and then whisking them away to prison because they’ve engaged in constitutionally protected speech that the regime doesn’t like.
"You think I’m exaggerating? This is exactly what happened to #MahmoudKhalil on Saturday night. Khalil, who graduated from #Columbia’s School of International and Public Affairs in December, has a green card. His wife, who is eight months pregnant, is an American citizen.
"Immigration agents appeared at his apartment building and told him he was being detained. He now appears to be in a detention facility in Louisiana.
"Khalil did nothing illegal. He has not been charged with a crime. He expressed his political point of view — peacefully, non-violently, non-threateningly. That’s supposed to be permitted — dare I say even encouraged? — in a #democracy.
"So why is he in jail?

On Tuesday, White House Press Secretary Karoline Leavitt said the decision to arrest Khalil, a green card holder who is of Palestinian descent, fell in line with President #Trump's recent executive order aimed at cracking down on antisemitism on U.S. campuses. The order allows the administration to revoke visas and deport international students if they're determined to be "pro-jihadist" or "#Hamas sympathizers."

Columbia University Student Detained by Following Threats of Deportation of Pro-Palestinian Students
The arrest comes on the heels of the Department of State’s announcement that it plans to deport students affiliated with pro-Palestine protests. The student, who is Palestinian, is a lawful permanent resident of the United States.On March 8, Department of Homeland Security (DHS) agents arrested Mahmoud Khalil, a Palestinian activist and recent graduate student at Columbia University, at his place of residence, an apartment building owned by the university. The DHS agents said that the U.S. Department of State had revoked Khalil’s green card. At approximately 8:30 p.m. ET, Khalil and his wife, a U.S. citizen who is eight months pregnant, had just unlocked the door to their building when two plainclothes DHS agents forced their way in behind them. The agents initially refused to identify themselves, instead asking Khalil to confirm his identity before detaining him without explanation. The agents proceeded to threaten his wife, telling her that if she remained by his side, they would arrest her too. Later, the DHS agents stated that the U.S. Department of State had revoked Khalil’s student visa, despite the fact that he has a green card, not a visa, and is a lawful permanent resident.
An agent showed Khalil what he claimed was a warrant on his phone. Khalil’s wife went into their apartment to retrieve his green card while the agents remained with Khalil downstairs. When she returned, advising them of Khalil’s legal status and presenting them with Khalil’s green card, one agent was visibly confused and said on the phone, “He has a green card.”
However, after a moment, the DHS agents stated that the State Department had “revoked that too.” Khalil’s wife then phoned his attorney, who spoke with the agents in an attempt to intervene. When Khalil’s attorney requested that a copy of the warrant be emailed to her, the agent hung up the call. Khalil is currently being detained in U.S. Immigration and Customs Enforcement (ICE) custody at 26 Federal Plaza pending an appearance before an immigration judge.
This significant deviation from normal immigration proceedings comes in the wake of increased and abnormal scrutiny concerning the actions of students alleged to hold pro-Palestine views. Axios recently reported that the State Department, Department of Justice, and DHS were launching a “Catch and Revoke” effort to identify alleged pro-Palestinian activists based on artificial intelligence screening of social media. Khalil has been specifically and discriminatorily targeted by Columbia University for his Palestinian identity and outspoken activism on multiple occasions over the last 17 months. He served as a lead negotiator during the Gaza Solidarity Encampment last spring. He has frequently appeared in media interviews and press conferences. The university suspended him while he was on a student visa and reversed it within the same day.
Columbia University has published guidance on how best to collaborate with federal enforcement, including advising faculty and staff “not to interfere” with ICE agents even if those agents are unable to present a warrant. Over the last few days, there have been several reports of ICE agents approaching pedestrians and students in the neighborhood surrounding Columbia University’s Morningside campus, creating unsafe environments for students (particularly students of color), regardless of their immigration status. Columbia’s continued acquiescence to federal agencies and outside partisan institutions has made this situation possible. A Palestinian student and member of the community has been abducted and detained without the physical demonstration of a warrant or officially filed charges.
Like many other Arab and Muslim students, Khalil has been the target of various zionist harassment campaigns, fueled by doxxing websites like Canary Mission. This racist targeting serves to instill fear in pro-Palestine activists as well as a warning to others. An activist familiar with Khalil’s solidarity work said, “Mahmoud is foundational to our community. The state has escalated its repression of student opposition to the U.S.-backed genocide in Palestine, in which Columbia and all American universities are complicit.” Despite the chilling effect of this repression, the activist said that students “will keep fighting for Palestinian liberation and against state violence.” Today, activists in solidarity with Khalil launched a petition demanding his release from ICE custody.

"Columbia University could hardly have been more draconian in the last year and a half since students began speaking out against Israel’s assault on #Gaza.
In early November 2023, four months before the Columbia #GazaSolidarity encampment even began, the university banned its chapters of #StudentsForJusticeInPalestine and #JewishVoiceForPeace. A few hundred students from the groups had had the audacity to walk out from classes and hold a “die-in” protest on campus — some of the most widely celebrated nonviolent protest tactics available.
"The crackdown was just getting started.
Since then, the university has ordered police raids on campus three times, leading to the arrests of over 100 students. Last week, the school expelled four students, three from #BarnardCollege one from Columbia. Many dozens of students have faced discipline and suspensions for participating in pro-Palestine protests and speech.
"Professors have been slandered before Congress, censured, removed from positions, and reportedly pushed into retirement over their support for Palestine and criticism of Israel. The campus has been essentially locked down for almost a year.
"Again and again, Columbia has shown a willingness to throw #students, #faculty, #FreeSpeech, and academic freedom under the bus in acquiescence to a #RightWing, #ProIsrael narrative that treats support for Palestinians as an affront to Jewish safety.
"For all Columbia’s #appeasement, President Donald Trump’s Federal Task Force to Combat Antisemitism announced last week that it would cancel $400 million in #FederalGrants and contracts to the university.
"'Columbia has worked overtime to appease,' wrote Layla, a student at Columbia’s School of Social Work, who asked to withhold her last name having faced doxxing attacks and harassment from Zionist groups. 'Students are miserable. Campus is a #panopticon. And their funding was still cut.'
"The Trump administration can be expected to use its perverted conception of antisemitism to further its explicit plans to decimate, #corporatize, and #ReWhiten #HigherEducation. The shame here lies with university leaderships — at Columbia and schools nationwide — that have failed to stand up for their purported missions of #CriticalThinking and #AcademicFreedom. NEW YORK (AP) — "Federal immigration authorities arrested a #Palestinian graduate student who played a prominent role in protests against #Israel at Columbia University, according to his attorney.
"#MahmoudKhalil was inside a university-owned residence Saturday night near Columbia’s Manhattan campus when several Immigration and Customs Enforcement agents entered his apartment and took him into custody, his attorney, Amy Greer, told The Associated Press.
"Greer said she spoke by phone with one of the ICE agents during the arrest, who said they were acting on #StateDepartment orders to revoke Khalil’s student visa. Informed by the attorney that Khalil was in the United States as a permanent resident with a green card, the agent said they were revoking that too, according to the lawyer.
"The arrest appeared to be among the first known actions under President Donald #Trump’s pledge to deport international students who joined the protests against the war in Gaza that swept college campuses last spring. His administration has claimed participants forfeited their rights to remain in the country by supporting Hamas, a terror organization.
"When ICE agents arrived at the campus building Saturday, they also threatened to arrest Khalil’s wife, an #AmericanCitizen who is eight months pregnant, Greer said. The authorities declined to say why Khalil was being arrested, according to the attorney."
